REGULATORY RADAR - The Trump administration gave notice to the U.S. Congress of its intent to sign a renegotiated North American Free Trade Agreement (NAFTA). The agreement—signed by Mexico, the United States, and Canada in 1994—allows the import and export of automobiles, manufacturing and retail products without paying tariffs.

REGULATORY RADAR - On September 27, 2018, the House of Representatives passed the Family Savings Act of 2018, which reforms retirement accounts and family-friendly saving accounts to increase flexibility and encourage savings. This bill exempts individuals less than $50,000 across all eligible retirement plans from required minimum distribution rules and repeals the maximum age for contributions to a traditional IRA, which is currently set at age 70 ½. .

REGULATORY RADAR - This month, California Governor Jerry Brown signed SB 212 into law, which establishes a statewide take-back system for needles and medications.

Regulatory Radar - On December 6, 2018, the Philadelphia City Council approved a regulation that will require employers to provide advanced notice of scheduling to workers.

REGULATORY RADAR - The New York City Taxi and Limousine Commission voted to set an earnings floor for drivers on ride-hailing apps, such as Uber and Lyft.

REGULATORY RADAR - Regulation to require solar panels in new residential construction received final approval from the California Building and Standards Commission in December 2018.

REGULATORY RADAR - Australia’s Modern Slavery Bill, which became law on November 29, 2018, calls for entities doing business in Australia with revenue exceeding AUD 100 million to publish a Modern Slavery Statement.

REGULATORY RADAR - Hungary passed a new labor law in December 2018 that has raised the yearly cap on overtime hours from 250 to 400, while giving employers three years to pay for accrued overtime.

REGULATORY RADAR - On December 27, 2018, Brazil’s President Temer issued an executive order to create a National Data Protection Authority charged with implementation and enforcement of the country’s new data protection law.

REGULATORY RADAR - On January 15, the New York legislature passed the Gender Expression Non-Discrimination Act (GENDA), which prohibits discrimination based on the bases of gender identity of expression.

REGULATORY RADAR - The National Labor Relations Board (NLRB) issued a new standard for determining if workers are considered independent contractors or employees.

REGULATORY RADAR - Workers in New Jersey will see the minimum wage rise beginning on July 1, 2019. A new bill signed by New Jersey Governor Phil Murphy, mandates that the state’s minimum wage will increase each year on January 1 by $1 per hour until 2024, when it will reach $15 per hour.
